Privacy policy

This policy describes how OUTOFPLACE POLAND sp. z o.o. - operator of the Portivo platform - processes the personal data of visitors to portivo.eu and clients of the platform. Processing is carried out in accordance with the GDPR (Regulation 2016/679) and the Polish Personal Data Protection Act of 10 May 2018.

1. Data controller

The controller of your personal data is OUTOFPLACE POLAND sp. z o.o., registered office at ul. Żabia 4, 18-400 Łomża, Poland, entered in the register of entrepreneurs of the National Court Register under KRS no. 0001163427, NIP 7182173789, REGON 541259259, share capital PLN 5,000, registry court: District Court in Białystok, 12th Commercial Division of the National Court Register.

2. Data we collect

Data you provide in contact and demo forms: first name, last name, email address, phone number, company name.

Technical data collected automatically: IP address, session identifier, browser type and version, operating system, timestamp, referring page, cookie identifiers.

We do not collect special categories of data (e.g. concerning origin, religion, health) without a clear and separate legal basis.

3. Purposes and legal bases

Responding to inquiries and organising demos - GDPR Art. 6(1)(b) (pre-contractual steps) and Art. 6(1)(f) (legitimate interest).

Marketing our own products and services - GDPR Art. 6(1)(f) (legitimate interest). You have the right to object.

Compliance with legal obligations (accounting, tax, KSeF) - GDPR Art. 6(1)(c).

Statistics, analytics and service security - GDPR Art. 6(1)(f) (legitimate interest in ensuring proper operation and security of the Platform).

4. Recipients of data

Cloud infrastructure providers (Amazon Web Services - servers in the EEA), transactional email provider (Amazon SES), analytics tools (with your consent - PostHog), legal counsel and accounting firm - under data processing agreements.

Data may be disclosed to state authorities only on the basis of applicable law.

5. Retention period

Demo and contact form data: up to 24 months from last contact, unless a contract is concluded.

Platform client data: for the term of the contract and for the limitation period of claims (usually 6 years).

Technical logs and security data: up to 12 months.

Data processed on the basis of consent: until consent is withdrawn.

6. Your rights

Right of access, rectification, erasure, restriction of processing, portability and objection to processing.

Right to withdraw consent at any time - this does not affect the lawfulness of processing prior to withdrawal.

Right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, Poland).

7. Transfers outside the EEA

We process data within the European Economic Area as a rule. If we use tools that may transfer data to third countries (e.g. the United States), we rely on the European Commission's Standard Contractual Clauses (SCC) and the Data Privacy Framework.

8. Automated decisions and profiling

We do not subject you to automated decisions producing legal effects or significantly affecting you, including profiling within the meaning of Art. 22 GDPR.

9. Changes to the policy

This policy may be updated. The current version is always available on this page with the last update date at the top of the document.
